STAYTION LTD, a UK registered company, with registered seat at 26 Cadogan Square, Chelsea, London SW1X 0JP (“Company”), offers its services to you and Hosts under the following Terms and Conditions of use (hereafter collectively referred to as the “Agreement”), which constitutes a legal agreement between you or Hosts and Company.

You should read them carefully and use the Services only if you agree and consent to the Agreement. By using the Website, you agree to be legally bound by the Agreement and the Privacy Policy set forth herein just as if you had signed them.

These terms and conditions, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the 'Website') and/or by completing a booking, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the Privacy Policy).

Unless otherwise stated below, all term and conditions apply to both Hosts and Users.

If you do not agree to these terms and conditions or our Privacy Policy and you are not willing to be bound by them, do not use our Website in any manner whatsoever.

The Website is owned, operated and provided by Company (26 Cadogan Square, Chelsea, London, SW1X 0JP, United Kingdom, reg. number: 11080839) and it is provided for: a) Hosts to advertise and book their accommodation and; b) users’ personal, non-commercial use only, subject to the terms and conditions set out below.

“Travelstaytion” is a registered trademark of Staytion Limited, UK company number 11080839.

 

Definitions and interpretation

For purposes of this Agreement, the following definitions apply:

  • "we", "us", "our" and "Company" refer to STAYTION LTD, a UK registered company, with registered seat at 26 Cadogan Square, Chelsea, London SW1X 0JP, and its affiliate (distribution) partners;
  • "you", "your", "yours" and "user(s)" refers to customer(s) using the Website;
  • "Website" refers to the Web applications through whatever platform owned by Company and used by you to book your stay or by Hosts to make accommodation available to Guests;
  • "Host(s)" means a person who has completed the registration and presents via the Website available accommodation for rent to Guests;
  • "Guest(s)" means a person who has completed the registration and requests a booking of an accommodation via the Website, or who stays at an accommodation and is not the Host for such accommodation;
  • "Service(s)" refers to services rendered by STAYTION LTD, through the use of the Website to you.

Scope of our Services

Through the Website we provide an online platform through which Hosts who have accommodation to rent can advertise their accommodation on line when available for reservation, and through which Guests to our Website can make such reservations. We are not a real estate agent, broker or insurer. We act solely as an intermediary between the Hosts and the Guests. From the point at which a Guest makes a booking through the Website, Hosts enter into a direct (legally binding) contractual relationship between them and the Guest. Company is not a party to any agreement entered into between Hosts and Guests, and has no control over the conduct of users of the Website or any accommodations and disclaims all liability in this regard.

Our Website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level or rating of any accommodation made available. Company’s responsibilities are limited to: (i) facilitating the availability of the Website and its Service and (ii) serving as the limited agent of each Host for the purpose of accepting payments from Guests on behalf of the Host.

 

Registration and Use of Website

For Users

You can search for accommodation in our Website without registering but you can only book and enquire your accommodation if you have registered. You may complete the registration form available on our Website here. Only individuals who are legally entitled may register. If you reside in a jurisdiction which restricts the use of the Services because of age, or restricts the ability to enter into agreements such as this one due to age, you must abide from any use of the Website and Services. If you are not legally entitled and/or you have had your account suspended or canceled, temporarily or permanently, you cannot register.

By registering, Users agree:

  1. to comply with all applicable laws from your home nation, the country, state and city in which you are present while using the Website or Services;

  2. to treat the accommodation introduced to you through our Website with respect and not to cause damage to the Host’s property;

  3. that the nickname or email (e.g [email protected]) that you use to register on the Website shall not resemble to company’s name or Travelstaytion trademark. Also nicknames deemed offensive may be deleted, as well as those containing a URL or email address;

  4. that you shall not use our Services or Website to cause nuisance, annoyance or inconvenience;

  5. that by accessing and using the Services via mobile devices, or by using certain mobile features, you may incur fees from the provider or carrier of the mobile services that you use and you are solely responsible for the payment of such fees;

  6. that you may not use our Website and Services to transmit, distribute, post or submit any information concerning any other person or entity, including without limitation, photographs of others without their permission, personal contact information or credit, debit, calling card or account numbers;

  7. that you may not "stalk" or harass any other user of our Website or Services or collect or store any personally identifiable information about any other user;

  8. that you may contact your Host only for asking questions related to your booking;

  9. that you may not when acting as a Guest, recruit or otherwise solicit any Host to join third party services or websites that are competitive to our Company, without our prior written approval;

  10. that you may not impersonate any person or entity, or falsify or otherwise misrepresent yourself or your affiliation with any person or entity;

  11. and acknowledge that we have limited control over the nature and content of information and chat transmitted or received by you or other users of the Website. Although we reserve the right to do so, we do not monitor such content in the usual course of business and will not be liable for any such content. If you have a complaint about another user please contact us via website;

 

Users may change at any time their registration information according to our Privacy Policy.

 

Company recommends that Users obtain appropriate insurance for their accommodations.

 

For Hosts

You can register if you are the owner or the person entitled or their official representative of accommodation(s) available to rent and you wish to advertise and book such accommodation(s) through our Website. Before registering, you shall ensure that your accommodation(s) are appropriate for renting in regards of safe and health standards and that you meet all legal requirements to proceed to such use of accommodation(s).

By registering, Hosts agree:

  1. to provide true, accurate, complete and updated information about yourself and the accommodation at the registration form, and update them whenever necessary. Company is not obligated to monitor or control the accuracy of information provided by you. If any information provided by you is not in accordance with these provisions or we have reasonable grounds to suspect that such information is not accurate, we have the right to refuse your registration, and suspend or terminate immediately, regardless of notice, the registration of your account and refuse any and every use, present or future, of the Services that require registration. In this case, you shall not be entitled to any indemnity or compensation for the refusal, suspension or cancellation of your registration;

  2. not to use our Services for any unlawful purpose; or in any way that interrupts, damages, impairs or renders Company less efficient; not to transfer files that contain viruses, trojans or other harmful programs; not to access or attempt to access accounts of other users or to penetrate or attempt to penetrate any security measures; not to disseminate any content which is defamatory, obscene, or may have the effect of being harassing, threatening or abusive to an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability or otherwise; not to advertise or promote third party or your own products or services;

  3. to refrain from doing anything which we reasonably believe to be disreputable or capable of damaging our reputation;

  4. to comply with all applicable laws from your home nation, the country, state and city in which you are present and/or the accommodation is located while using the Website or Services;

  5. to comply with GDPR provisions and any other data protection regulation applicable in your territory and ensure that you protect Guests’ data as instructed by the law;

  6. to compensate and hold us harmless against any claims or legal proceedings brought against us by any other person as a result of your breach of this agreement;

  7. that the name and the email (e.g [email protected]) that you use to register on the Website shall not resemble to Company’s name or Travelstaytion trademark. Also, names deemed offensive may be deleted, as well as containing a URL or email address.

  8. that you will only use this Website to offer or secure legitimate accommodations for you or for another person for whom you are legally authorized to act;

  9. that you may not have more than one (1) active account;

  10. that you may not use our Website or Services in connection with the distribution of unsolicited commercial email ("spam") or advertisements unrelated to lodging in a private residence;

  11. that you may not "stalk" or harass any other user of our Website or Services or collect or store any personally identifiable information about any other user other than for purposes of transacting as a Host;

  12. that you may not offer, as a Host, any accommodation(s) that you do not yourself own or have permission to rent as a residential or other property (without limiting the foregoing, you will not list accommodations as a Host if you are serving in the capacity of a rental agent or listing agent for a third party);

  13. you may not offer, as a Host, any accommodation that may not be rented or subleased pursuant to the terms and conditions of an agreement with a third party, including, but not limited to, a property rental agreement;

  14. that you may contact a Guest in regards to her/his reservation only;

  15. that you may not try to contact any User or Guest in order to complete a booking bypassing the obligation to pay any Service Fees to us, such as exchanging personal contact details, like emails, URLs, phone numbers with any User prior to her/his booking;

  16. that you may not impersonate any person or entity, or falsify or otherwise misrepresent yourself or your affiliation with any person or entity;

  17. that you may not use automated scripts to collect information or otherwise interact with the Website or Services;

  18. that you may not as a Host, submit any accommodation with a false or misleading price information, or submit any accommodation with a price that you do not intend to honor;

  19. that once a Guest requests a booking of your accommodation, the price for such booking may not be altered;

  20. that Company bears no responsibility for a User's compliance with any applicable laws, rules and regulations;

  21. that, as a Host, you are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals who reside at or are otherwise present at the accommodation at your request or invitation or employment or service, excluding the Guest (and the individuals the Guest invites to the accommodation, if applicable.)

 

Users and Hosts are solely responsible for maintaining the confidentiality of their password chosen by them for registering. Company is not responsible for any harm resulting from disclosure of such password from Users or Hosts to third parties or use of their password by a third party to access their accounts. In the event of any unauthorized use of an account, immediately notify the Company at [[email protected]].

Information

When rendering our Services, the information that we disclose is based on the information provided to us by Users and Hosts. As such, Users and Hosts are fully responsible for informing us with their updated information. Although we will use reasonable skill and care in performing our Services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Hosts remain responsible at all times for the accuracy, completeness and correctness of the (descriptive) information displayed on our Website.

Our services are made available to Users for personal and non-commercial use only. Therefore, Users are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our Website for any commercial or competitive activity or purpose.

Hosts may add accommodations upon their registration at the Website. When adding an accommodation, Hostswill be asked a variety of questions about it, including, but not limited to its location, capacity, size, features, of the accommodation and pricing and related rules. All accommodations must have valid physical addresses, in order to add an accommodation to the Website. Accommodations will be made publicly available via the Website. Guests will be able to book accommodations via the Website based upon the information provided by the Host.

Booking Process

Guests can offer to make a booking through the Website by following the processes for making an availability request set out on the Website and below.

Once your availability request has been made, the concerned Host will be notified and may accept or reject the availability request. Hosts are required to either confirm or reject your availability request at any time. If the availability request is subsequently accepted by the Host through our Website, you will receive an automated email confirming the Host's booking availability.

If you are still interested for that booking, you should click on the BOOK NOW button, and the concerned Host will be notified and may accept or reject the booking request. Hosts are required to either confirm or reject your availability request within 24 hours of that request, after which the booking request shall automatically expire. If the booking request is subsequently accepted by the Host through our Website, you will receive an automated email confirming the Host's booking confirmation, and the Host's relevant contact details, and your relevant contact details will also be forwarded to the Host. The payment process described below will also apply upon receipt of a booking confirmation. If at any time prior to clicking on the appropriate confirmation button the Guest decides that does not wish to proceed with the booking, Guest should close the application window. Once such contact details have been provided, all communication for example, concerning details and information about the booking including, without limitation, arrival times and handling of keys, should be direct between you and the Host through our Website as facilitated by our Service where required/applicable.

You will be able to access details of your booking confirmation through your account and email.

Upon receipt of the booking confirmation mail, Guests enter into a direct contract with the concerned Host. Hosts are not obliged to make any property available until a booking confirmation has been sent via the Website to Users and a Guest is not guaranteed a booking with a Host until payment has been made by the Guest subject to this Agreement. However, upon issuing a booking confirmation, Hosts shall be solely responsible for providing the accommodation referred to in the booking confirmation.

If a Guest clicks the BOOK NOW button, they will be responsible and liable to pay the relevant Host in full the rental rate due for such booking subject, in each case, to this Agreement and any other terms and conditions specific to the booking as agreed between a Guest and their Host. In order to secure collection of such payment, Guests will be asked during the booking process to provide payment card information and billing address. If your booking request is accepted by the Host for the dates set out in your request and you click the BOOK NOW button, the payment process described below will apply. If a booking request is refused, expires, or is cancelled, you should contact us at [email protected] in order to release any pre-authorisation of your payment card.

As a Guest, if you cancel your booking, the provisions and refund levels referred to below will apply. Please note that no refunds will be provided after the last deadline set out in the cancellation policy selected by the concerned Host. Furthermore, our Fees (as defined below) are non-refundable. Any money collected and received by Company from Guests for bookings made on the Website shall be held by Company subject to a conditional obligation to transfer or account for such money to Hosts less our Fees.

If you are a Host and a booking is requested for your Accommodation via the Website, you will be required to either confirm or reject the booking within 24 hours of when the booking is requested (as determined by Company in its sole discretion) or the booking request will be automatically cancelled.

 

Payment and Refund

When the rental transaction is concluded with a Host via our Website, the Guest accepts and agrees to pay an amount equal to the fees displayed in the Host's accommodation on our Website and confirmed in each booking confirmation as agreed with a Host. The fees displayed in a Host's accommodation on our Website include: (a) the rental rate and any additional charges as solely determined and set by the Host (and not us) in respect of the rental transaction, plus any applicable taxes and VAT ("Host Fee"); and (b) a service fee, chargeable and disclosed to Hosts by the Company based upon a percentage (typically 15%) of the Host Fee, in consideration of supplying our Services to Hosts to the extent that such supplies enable such Hosts to connect and conclude transactions with Guests and which shall be added by way of a mark - up on top of the Host Fee; (" Company’s Fees" or “Our Fees”). Our Fees are non-refundable and are exclusive of any applicable Taxes and VAT which may be charged in addition thereon, and shall be added to the Host Fee to calculate the total amount payable by the Guest for the stay.

The Company shall collect a payment from you (the Guest) equal to the Host Fee and our Fees through the Website immediately when the Host accepts your booking and a booking confirmation is sent to you by the Host. Hosts set the currency in which they require payment. As referred to in the present Agreement, the Company shall initiate the payment, less our Fees, to the bank account of the Host in the currency set by the Host within two UK business days (meaning days that banks are open in UK) of the planned date of the Guest's check-in at the rental property, subject to any other arrangement as may be agreed between a Host and the Company.

As a Guest, you hereby authorise and agree that the Company shall debit (whether directly or indirectly via a third party payment processor, subject to that third party's terms and conditions) your payment card of the amount of the Host Fee plus our Fees upon confirmation of your booking by the Host. You also agree to pay any other charges agreed with the Host before the booking confirmation that weren't included in the payment when you arrive at the property or as otherwise agreed with the Host. You will receive a further notification email for receipt of the payment.

The payment shall be taken by a debit of the Host Fee plus our Fees from one of the acceptable payment methods listed on the Website (Viva, Paypal and Stripe) and such payment shall be taken in the currency set by the Host. Payments by cash or cheque are not accepted, and accordingly we cannot be held liable for any loss of cash or cheques. As a Guest, you agree to pay all fees and charges contained in the Host's booking confirmation as accessed through your account, irrespective of whether the Service was accessed by you or by a third party using your Account.

We serve as a limited authorized agent of the Host for the purpose of accepting payments from Guests on behalf of the Host and we are responsible for transmitting such payments to the Host.

 

Appointment of the Company as Payment Agent of Hosts

Each Host by registering in the Webiste appoints the Company as the Host's limited agent solely for the purpose of collecting payments made by Guests on behalf of the Host. Each Host agrees that payment made by a Guest to the Company shall be considered the same as a payment had been made directly to the Host and that the Host will make the accommodation available to Guest in the agreed upon manner as if the Host has received the accommodation Fees. Each Host agrees that the Company may, in accordance with the cancellation policy selected by the Host and reflected in the relevant accommodation (a) permit the Guest to cancel the booking and (b) refund to the Guest that portion of the Accommodation Fees specified in the applicable cancellation policy. In accepting appointment as a limited authorized agent of the Host, we assume no liability for any acts or omissions of the Host.

 

Prohibited Uses – Intellectual Property Rights

Any and all content including, but not limited to, trademarks, logos, symbols, domain names, trademarks, designs, industrial designs, images, photographs, backgrounds, icons, navigation tools, texts, among others, of the present software or related to products and goods displayed on the Website are protected by copyright and intellectual property and are owned by the Company or third parties authorized by the Company to develop activities on the Website. Users and Hosts agree to respect the intellectual property rights of the Company and others and is aware that intellectual property in this Website can never be used in any manner and in any media without our prior written permission of the Company.

The Company is not liable for damages suffered by a User or Host who has copied, transferred, distributed or otherwise protected content used in this Website, violating rights of third parties.

The Company hereby grants you a non-exclusive, non-transferable, right to use the software and our Services, solely for the purposes of advertising or offering an accommodation for rent through our Website (for Hosts) or for search or making a booking of an accommodation (for Users), subject to the terms and conditions of this agreement. All rights not expressly granted to you are reserved by the Company and its licensees.

Except as specifically permitted herein, without our prior written consent you agree not to: (i) use, modify, incorporate into or with other the Website, or create a derivative work of any part of the Website; (ii) copy, distribute or reproduce the Website for the benefit of third parties; (iii) disclose the results of any benchmarking of the Website, or use such results for your own competing Website development activities; and/or (iv) modify, disassemble, decompile, reverse engineer, revise or enhance the Website or attempt to discover the software's source code.

 

Prohibition of assignment

You agree not to sell, license (or sub-license), lease, assign, transfer, pledge, or share your rights under this agreement with or to anyone else, unless we provide you our prior consent for such action.

 

Ranking and Users reviews

We provide ranking for Host’s accommodation(s). Ranking is displayed as score/5. Ranking is based on comfort features provided from the property, the host reception services provided from the Host, the number of accepted bookings compared, the response time, the number and the value of accepted bookings of the host, the review score from previous guests.

Also, we provide Guest with the ability to write and publish a review of their experience at the Host’s accommodation and the services they enjoyed.

Hosts agree that Guests may evaluate the accommodation and the services rendered to them. When doing so, Guests are encouraged to be objective in their evaluation and also required to avoid any offensive or insulting remarks against other persons.

The completed Guest’s review may be (a) uploaded onto the relevant User’s information page on our Website for the sole purpose of informing (future) users of your opinion of the service (level) and quality of the accommodation, and (b) (wholly or partly) used and placed by the Company at its sole discretion (e.g. for marketing, promotion or improvement of our service) on our Website or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by us. We reserve the right to adjust, refuse or remove reviews at our sole discretion.

The Guest’s review should be regarded as a survey and does not include any (further commercial) offers, invitations or incentives whatsoever.

 

Disclaimer (for Hosts)

By entering into this agreement and using the Website or Services, to the extent permitted by law, Hosts agree to defend, indemnify and hold the Company, its licensors and each such party's parent organizations, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, shareholders, officers, directors, employees, representatives, members, attorneys, licensees, agents, or others involved in creating, sponsoring, promoting, or otherwise making available the Website and its contents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with: (i) any inaccuracy relating to the (descriptive) information of the Hosts and their accommodations, as made available on our Website, (ii) any default in regards to the services rendered by the Host to the Guest, (iii) for any (personal) injury, death, property damage which incurred during a Guest’s visit, whether due to illegal acts, errors, breaches, negligence or gross negligence, willful misconduct, omissions, non-performance, or tort by or (wholly or partly) attributable to the Host (its employees, directors, officers, agents, representatives or affiliated companies), (iv) any Host’s violation or breach of any term of this Agreement or any applicable law or regulation (including GDPR or other applicable data protection legislation), whether or not referenced herein.

Company bears no responsibility and is not liable in any way for any of the following: (a) the use, inability to use or delay or virus of our Website and/or the server that the Website is hosted; (b) any cancellation or partial cancellation, double-booking, strike, force majeure or any other event beyond our control; (c) any external site linked to the Website, over which we have no control and for which we assume no responsibility.

 

Limitation of Liability (for Guests and users)

The Company may introduce you (Guests and users) to Hosts for the purposes of providing accommodation. We will not assess the suitability, legality or ability of any Host and you expressly waive and release the Company from any and all liability, claims or damages arising from or in any way related to the Host’s accommodation and services. You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the Website and our Services and collective content, your booking of any accommodations via the Website and Services and any contact you have with other users of Website whether in person or online remains with you. The Company will not be a party to any disputes, negotiations of disputes between you and such Host. Responsibility for the decisions you make regarding services offered via the Website or a Host (with all its implications) rests solely with you. By accepting the provision of our services, you acknowledge that the Company has no involvement in the contractual relationship between you and the Host(s).

 

Termination

Company may notify, suspend or terminate, temporarily or permanently, the account of a Host or a User at any time and take appropriate legal action if: (i) the Host or User violates any of the representations, warranties and obligations contained in these Terms and Conditions (as cited above) or any policies and rules adjacent to it, (ii) the Host or User proceeds to fraudulent practice or fraudulent acts, (iii) comes to the Company’s attention that the Host or User has violated any applicable legislation (including GDPR or other applicable data protection legislation) or (iv) Company understands, in its sole discretion, that the activities and attitudes of the Host or User have caused or may cause some damage to third parties or the Company. The Host or User shall not be entitled to any damages or compensation for the cancellation or suspension of its account on the Website.

You are under no obligation to use the Website and our Services and may simply choose to stop using it at any time.

 

Internal complaint-handling system for Hosts

We aim to provide a high quality of service at all times. However, if you would like to raise a complaint regarding any of the following: (i) alleged non-compliance by the Company with any legal obligation on online intermediation services providers, which has negatively affected you; (ii) technological issues of the Website which have negatively affected you in a non-negligible manner; or (iii) measures taken or behavior by the Company related to our Services which negatively affects you in a non-negligible manner, let us know by contacting [email protected].

We undertake to look into any complaint carefully and promptly and to do all we can to explain our position to you. We treat all complaints in a serious and confidential manner, as appropriate in each case.

Within 48 working hours, after receiving your complaint, we will reply to you (to the same e-mail address) to verify that we have received your complaint and let you know of the time by when you will have our answer. The time is determined by the seriousness and the complexity of the complaint raised.

In case you have raised a complaint orally (even though we encourage you to send us an e-mail instead), you will receive within the same time as above an e-mail confirming the complaint you made orally and the time by when you should expect our answer. If you think that our e-mail does not include your complaint, as raised by you orally, or if you think that amendments/additions/deletions, please reply to our e-mail clarifying the exact content of your complaint.

We will reply to your complaint within the time we have set to explain you our position on the matter or inform you of the steps we have taken to correct any failures.

 

License to Company

Hosts hereby grant the Company the license and right to publish, share, display or in any other way use their trademarks, logos, brand names, companies’ names and distinctive titles or any other intellectual property they may share with the Company, only in regards to Company providing its Services to Hosts in advertising their accommodations and promoting them to protentional Guests and for no further use. Should a Host’s account is terminated this license is automatically revoked.

Reporting Misconduct

If you stay with or host anyone who you feel is acting or has acted inappropriately, including but not limited to, anyone who (i) engages in offensive, violent or sexually inappropriate behavior, (ii) you suspect of stealing from you, or (iii) engages in any other disturbing conduct, you should immediately report such person to the competent local authorities and then to the Company by contacting us with your police station and report number at [email protected] provided that your report will not obligate us to take any action beyond that required by law (if any) or cause us to incur any liability to you.

 

Feedback

We welcome and encourage you to provide feedback, comments and suggestions for improvements to the Website and Services. You may submit Feedback by emailing us at [email protected] or through the "Contact" https://www.travelstaytion.com/contact) section of the Website. At the Company’s request and expense, you will execute documents and take such further acts as we may reasonably request to assist Company to acquire, perfect, and maintain its intellectual property rights and other legal protections for the Feedback.

Maintenance and Support

We have no obligation to provide support, maintenance, upgrades, modifications, or new releases under this agreement. However, we may from time to time issue upgraded versions of the Website, and may automatically electronically upgrade the version of the Website that you are using. You consent to such automatic upgrading, and agree that the terms of this agreement will apply to all such upgrades.

 

Assignment

This agreement may not be assigned by you without the prior written approval of the Company but may be assigned without your consent by the Company to (i) a parent or subsidiary, (ii) an acquirer of assets, or (iii) a successor by merger. Any purported assignment in violation of this section shall be void.

 

Miscellaneous

These terms and conditions constitute the entire understanding between User(s), Guest(s) or Host(s) and the Company with respect to its object, replacing any and all instruments, agreements, letters and / or contracts, oral or written agreements between the parties with respect to the subject matter described herein prior to the date of your registration in the Website.

Nothing in the terms and conditions will constitute a partnership, agency relationship, franchise relationship or contract of employment between the parties.

If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.

The failure by Company to exercise any right at any time or to perform any provision of this agreement will not affect in any way the right of Company to exercise such right or enforce such provision thereafter.

We may amend these Terms & Conditions from time to time. We will notify Hosts of the envisaged modifications before implementing modified Terms & Conditions. Modified Terms & Conditions shall be implemented 15 days after notification is made to Hosts. During this period, Hosts who don’t accept modified Terms & Conditions for any reasons, may de-activate their account.

These Terms and Conditions shall be construed and governed by the Laws of England and Wales. Any dispute arising out or in connection with this agreement shall be subject to the exclusive jurisdiction of the English Courts.

The original English version of these terms and conditions may have been translated into other languages. The translated version is a courtesy and office translation only and you cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these terms and conditions or inconsistency or discrepancy between the English version and any other language version of these terms and conditions, the English language version to the extent permitted by law shall apply, prevail and be conclusive. The English version is available on our website (by selecting the English language) or shall be sent to you upon your written request.

Privacy Policy

The information we request when making your registration at Travelstaytion Website, is requested in order to offer you our professional service. We will only disclose your personal information to third parties for the purposes of completing your booking through us, in order to provide you with the information or services you have requested, or with your explicit consent. We reserve the right to disclose your personal information to certain permitted third parties including members of our own group, trusted partners and our own professional advisers. We would again like to stress that, in accordance with European personal data protection laws, strict security procedures are observed to prevent personal data misuse and unauthorised access.

What personal information we collect In general, the personal information we gather enables us to process your bookings and to provide the Travelstaytion services to you. We collect personal information that you submit to us voluntarily when you register with us or when you use the Travelstaytion Services.

Registration

When you register in Travelstaytion to use the Website you will be asked to complete online forms providing for: your first name, last name, username, e-mail address and a password. This information is required in order to use Travelstaytion and enjoy our Travelstaytion services. The information will not be re-used for an incompatible purpose to our scope of our service as described at the Terms and Conditions.

User Account

You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your account. You may allow other members of your household to use the Website under your name or account, provided that you hereby agree to pay all charges that they incur and to be responsible for all other aspects of their usage. You agree to supervise all usage by minors of this Website under your name or account. If you wish to apply for a job on our site we will collect personal information such as your name, email address, phone number and additional information such as resume, gender, and your ethnicity. We use the information collected within this area of the site to determine your qualifications for the position in which you have applied and to contact you to set up an interview.

What we do with the information we gather

Our primary goal in collecting information is to provide you with an enhanced experience when using the Travelstaytion service. We use this information to closely monitor which features of the Travelstaytion service are used most, to allow you to view your booking history, view any promotions we may currently be running, rate accommodations and Guests, and to determine which features we need to focus on improving, including usage patterns and geographic locations to determine where we should offer or focus services, features and/or resources, for troubleshooting and in some cases marketing purposes. The Company uses your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer the Website. Your IP address is used to help identify you, and to gather broad demographic data. Your IP address contains no personal information about you. We may also use your personal information to create anonymous information records by excluding information that makes the information personally identifiable to you. We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account. On the other hand, you can always opt out of receiving certain communications from Travelstaytion such as our newsletter by clicking the "Unsubscribe" link at the bottom of each email or emailing us at [email protected]. Please note that even if you unsubscribe or opt-out, we may still send you booking related communications (e.g., mail related to your booking).

Customer Service

Based upon the personally identifiable information you provide us, we will send you a welcoming email to verify your username and password. We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by email or telephone, in accordance with your wishes.

Reservation

When you make a reservation for any type of accommodation , you will be asked to complete online forms providing for: your name, (home or office) address, (business or private) email address, (mobile, home or office) telephone number, credit card details (i.e. credit card type and number, CVC code, expiration date, credit card holder name) and to the extent available, reservation preferences and smoking preference. This information is required to process, book and complete your reservation (including the sending of a confirmation email of the booking to you). The information will not be re-used for an incompatible purpose to our scope of our service as described at the Terms and Conditions.

Payment submission

We use Stripe and Paypal as third-party payment systems. We do not retain any payment card information, nor we do share financial details with any third party. Any and all payments or fees charged by third-party service providers such as Paypal shall be borne by the Users themselves unless otherwise stated. When you make your online reservation, you automatically, accept the conditions and merchant's policy you have chosen.

How we share personal information with Hosts

Please remember that this privacy statement addresses only our use and disclosure of information we collect from and/or about you. When you authorize us to disclose information to Users, the use and disclosure restrictions contained in this privacy statement will not apply to them. While we encourage them to comply with our data protection requirements, we will not be responsible if these Users fail to comply with respect to your information. We do not control the privacy policies or actions of third parties, including the Users. Any complaints or inquiries regarding use of your information by a User, or marketing communications from a User, should be addressed directly to the User in question. Users within the Travelstaytion network may also have their own websites. Travelstaytion is not responsible for how these Users may collect your personal information through their own websites. Please contact the appropriate User regarding its website's privacy policy (if applicable) and how it will access or use your personal information. At the end of your stay, if you evaluate the User that has rendered his services to you, you hereby agree and accept that these information, including any comments, will be also sent to that User.

How we share Personal Information with other parties

In addition to the ways we share Personal Information with Hosts, we may share your Personal Information with other third parties in the following manners:

  1. Service providers under contract who help with parts of our business operations (e.g., marketing, technology services), though we require that these service providers only use your information in connection with the services they perform for us and not for their own benefit;

  2. To a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, "Affiliates"), in which case we will require our Affiliates to honor this Privacy statement;

  3. To a company that merges with us, acquires us, or purchases our assets, in which case such company may continue to process your Personal Information as set forth in this Privacy statement;

  4. Law enforcement, government officials, or other third parties when

    • we are compelled to do so by a court order or similar legal procedure

    • we need to do so to comply with law

    • we believe in good faith that we need these information to protect or defend the rights or property of Company or users of the Website or other services.

How do we treat the e-mails you send us?

Our "Contact" button, activates your e-mail Website and invites you to send your comments to a specific functional mailbox. When you send such a message, your personal data is collected only to the extent necessary to reply. If the management team of the mailbox is unable to answer your question, it will forward your e-mail to another service. You will be informed, via e-mail, about which service your question has been forwarded to. Our Website includes social media features, such as the Facebook Like button and widgets, such as the Share this button or interactive mini-programs that run on our site. You can also register to join Travelstaytion by logging into your account with certain third party social networking sites (including, but not limited to, Facebook). We will create your Travelstaytion account and your Travelstaytion account profile page for your use of the Website based upon the personal information you provide to us or that we obtain via a social networking site that you have granted us access to.These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Website. Your interactions with these features are governed by the privacy statement of the company providing it.

Public

Our Website offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Once you (the Guest) have made a reservation through our Website and have received a confirmation e-mail, you may wish to review, adjust or cancel your reservation. In this case please revert to the confirmation email and follow the instructions therein. Kindly bear in mind that: a) our Fees are not refundable under no circumstances (except the case of a cancellation by a Host – please refer below for more information) and b) you may be charged for your cancellation depending on the Host's cancellation (and no-show) policy. We recommend that you read the cancellation (and no-show) policy of each Host carefully prior to making your reservation.

 

We offer Hosts six different cancellation (and no-show) policies: i) super flexible, ii) flexible, iii) moderate, iv) strict, v) super strict, vi) firm or
vii) extremely strict as these policies are explained below. Each Host is free to choose the cancellation (and no-show) policy that best fits its needs.

 

The cancellation (and no-show) policy of each Host is made available on our Website at the accommodation information pages, during the reservation procedure and in the confirmation email, you will receive.

 

By making a reservation at a Host, you accept and agree to the relevant cancellation (and no-show) policy of that Host, and to any additional (delivery) terms and conditions of that Host which may apply to your reservation or during your stay, including for services rendered and/or products offered by the Host (the delivery terms and conditions of a Host can be obtained by the relevant Host).

 

Cancellation (and no-show) policies aim in protecting both Guests and Hosts and stipulate the amount of money that may be refunded to Guest in case of cancellation or no-show. The refunded amount of money is determined by the time the Guest cancels his/her reservation and by the selected cancellation (and no-show) policy from the Host. The refundable amount of money includes additional Guests’ charges and cleaning fees. The company’s fees are not refundable and are not included in the refundable amount.

Cancellation (no-show) policies:

 

 

i) SUPER FLEXIBLE

 

The guest will be refunded the full amount of the booking fees if (s)he cancels the booking up to one week prior to his/her arrival day (check-in) to the Host’s accommodation.

 

All cancellations must take place by 12:00 (midday) according to the Central European Time (CET), on the appropriate day.

 

 

ii) FLEXIBLE

 

The guest will be refunded the full amount of the booking fees if (s)he cancels the booking up to 2 weeks prior to his/her arrival day (check-in) to the Host’s accommodation.

 

The guest will be refunded 50% of the booking fees, if (s)he cancels the booking up to 1 week prior to his/her arrival (check-in) to the Host’s accommodation.

 

All cancellations must take place by 12:00 (midday) according to the Central European Time (CET), on the appropriate day.

 

iii) MODERATE

 

The guest will be refunded the full amount of the booking fees if (s)he cancels the booking up to 1 month prior to his/her arrival day (check-in) to the Host’s accommodation.

 

The guest will be refunded 50% of the booking fees, if (s)he cancels the booking up to 2 weeks prior to his/her arrival (check-in) to the Host’s accommodation.

 

All cancellations must take place by 12:00 (midday) according to the Central European Time (CET), on the appropriate day.

 

 

iv) STRICT

 

 

The guest will be refunded the full amount of the booking fees if (s)he cancels the booking up to 2 months prior to his/her arrival day (check-in) to the Host’s accommodation.

 

The guest will be refunded 50% of the booking fees, if (s)he cancels the booking up to 1 month prior to his/her arrival (check-in) to the Host’s accommodation.

v) SUPER STRICT (This policy is by invitation only to certain hosts under special circumstances)

 

The guest will be refunded 50% of the total booking if (s)he cancels the booking up to 1 month prior to his/her arrival day (check-in) to the Host’s accommodation.

 

No refund will be given, if (s)he cancels the booking less than one month prior to his/her arrival (check-in) to the Host’s accommodation.

 

All cancellations must take place by 12:00 (midday) according to the Central European Time (CET), on the appropriate day.

 

 

vi) FIRM (This policy is by invitation only to certain hosts under special circumstances)

 

No refund will be given, if (s)he cancels the booking at any time.

vii) EXTREMELY STRICT (This policy is by invitation only to certain hosts under special circumstances)

 

The guest will be refunded 100% of the total booking if (s)he cancels the booking up to 42 days prior to his/her arrival day (check-in) to the Host’s accommodation.

 

No refund will be given, if (s)he cancels the booking less than 42 days prior to his/her arrival (check-in) to the Host’s accommodation.

 

All cancellations must take place by 12:00 (midday) according to the Central European Time (CET), on the appropriate day.

 

 

 

How can I cancel my booking?

All cancellations must be controlled and processed by our Company. You must always contact us in these cases. In order to cancel your booking, you just have to send us an e-mail to [email protected] or call us at +44(0)20 3624 0359 and provide us with your booking details.

 

Your cancellation is official once both parties (Guests/Hosts) receive a confirmation from our Company.

 

Can Guest cancel after the check-in?

A Guest may cancel his/her booking up to 24 hours after (s)he has checked in, if (s)he has serious complaints about his/her booking.

 

Our support team will cancel the booking and may entitle the Guest with a full refund depending on the reason for cancellation. For example, if the Guest’s cancellation is because (s)he does not like the accommodation although it was properly described by the Host in our Website, Guest will not be entitled to any refund.

 

Cancellation made more than 24 hours after check-in, will not entitle Guests with a full refund.

 

 

Cancellations by the Company

We reserve the right to cancel any booking at any time for security or fraud-protection purposes. In such cases cancellation policies will not apply, Hosts will receive no payment for the cancelled booking and where payment has been taken, Guest will receive a full refund on the card used for the booking.

 

Cancellations by Hosts

If Host cancels a booking, the Company is able to charge Host 15% cancellation fees and decrease the rating of Host’s listing in the search results.

 

Guests will receive a full refund of his/her booking, including our fees. Also, we are more than happy to help you find alternative accommodation and provide all appropriate assistance. In the event that no alternative accommodation is available or you do not accept the alternative listed property offered by the same Host or by a new Host, your payment will be fully refunded to you. No further payments or refunds will be made by our Company.

 

Additional fees

Hosts may set additional charges in the form of a deposit or otherwise (for example late checkout fees) that are due by Guests. Such additional fees, which are not included or factored in the Host Fee may be expressly stated in the booking summary page or may be agreed with the Host by separate arrangement and in any case, are directly charged by a Host. Payment of such additional charges (for example upon arrival or check-out) shall be made by Guests directly to the Host in accordance with the terms you agreed with the Host.

 

As noted in this Agreement (please refer to “Terms & Conditions”), the Company shall not be responsible for administering or accepting a Host's requests or claims related to such additional charges or payments and disclaims any liability in this respect.
